AirPocket LLC (“AirPocket”) has instituted a comprehensive set of privacy policies and procedures to ensure that customers, visitors,and users (collectively, “Users”) of its website, airpocket.com, mobile websites, and mobile applications (collectively, “Application(s))never have their privacy compromised. The purpose of this privacy notice is to inform our Users of the type of information that AirPocket, or a credit card processing partner or other vendor acting on our behalf, collects, how the information is gathered, how it is utilized, how long it is retained and how customers and visitors can restrict its use or disclosure.
We collect personal and non-personal information from customers based upon our business relationship and the nature of the products and services we provide. The types of information we may collect include account information (such as your name, address, home or alternate telephone number), certain financial information relating to any products and/or services that you purchase directly from us (including credit card information, security code and billing address), telephone numbers you call and that have called you and your service history, amongst other information.
In an effort to combat money laundering activities and the funding of terrorism, AirPocket obtains from Customers certain personal information (such as your name, address, date of birth) as part of the registration process to gain access to our products and services and create a Profile. We may also request other identifying documents or information about you and/or require that you provide personal identifying information about individuals you may have purchased our products or services for. If you refuse or fail to provide the requested information, we may decline to create a Profile for you or provide the requested products or services to you, or may discontinue providing the products or services to you at any time, in our sole discretion. We may also lawfully obtain information about you from other sources without your knowledge, including non-personal identifying information that we may obtain while you visit our Applications. You authorize us, directly or through third-parties, to make any inquiries we consider necessary to validate you or any other individual’s information. This may include asking you for additional information, requiring you to take steps to confirm ownership of your e-mail address, mobile device or financial instruments, or verifying your information against third party databases or through other sources. We may provide information about you and your transactions to government authorities and enforcement agencies, as further described herein. You represent and warrant that your use of AirPocket’sproducts or service does, and will, not violate any law, including without limitation, laws relating to money laundering, illegal gambling activities, support for terrorist activities or fraud.
We also collect and maintain technical information about the equipment you use with our service including serial numbers, SIM card numbers, etc. In some instances, AirPocket may collect information that is not "customer identifiable information." Some examples of this type of information include the type of Internet browser you are using, the type of operating system you have configured on your computer, and the domain name of the Application and/or Internet Service Provider from which you are linked to our Applications. AirPocket primarily uses this information for market research and optimizing its systems in order to deliver the best customer experience possible.
AirPocket may, however, use and/or disclose customer identifiable information to a third party:
to investigate and help prevent potential fraud, other unlawful activity or activity that threatens the network. Specifically,AirPocket pools certain hashed elements of the Service Data along with other dataattributes provided by other Users of the Applications (“Antifraud Reputation Pool”) in order to match transaction information for the purpose of evaluating the likelihood of fraud associated with a given transaction, user or merchant. Users acknowledge, that once such Service Data is part of the Antifraud Reputation Pool it is not identifiable as coming from User nor separately removable. In providing the Service, AirPocket warrants that no data is provided to any of its Users that allow Users to profile another User’s purchasing behaviors or to obtain any personal information of another User. All data is solely used for purposes of determining fraud, reputation, and identity as it relates to the Service as defined in the User Agreement.User grants AirPocket a perpetual, non- terminable , royalty free license to utilize the Service Data as part of the Antifraud Reputation Pool. All data is solely used for purposes of determining fraud, reputation, and identity as it relates to the Service. AirPocket shall provide those aspects of the User’s Service Data whichindicate the likelihood of a fraudulentTransaction to relevant parties to investigate and help prevent potential fraud or unlawful activity or any activity that threatens the network. as required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request; to any other third party with your prior consent to do so; if AirPocket is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via a prominent notice on our Applications of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
We will retain your information only as long as needed for business, tax and/or legal purposes or for 5 years. . We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. We will destroy your information once it is no longer needed.
AirPocket will only send our customers e-mail regarding promotional offers or other news if a customer grants us permission to do so and provides an email address. A customer has the right to choose not to receive AirPocket e-mail direct marketing communications by opting-out or unsubscribing. A customer can opt-out or unsubscribe from our e-mail list by clicking on the unsubscribe link found at the bottom of every message or promotion delivered electronically to our customers. Upon such election, AirPocket (a) will not contact that customer directly with AirPocket promotional messages, and (b) will not use customer identifiable information obtained from that customer's registration to contact that customer with AirPocket product or service messages.
AirPocket has gone to great lengths to implement technology and security features to safeguard the privacy of your customer identifiable information from unauthorized access or improper use. When you enter sensitive information (such as a credit card number or bank account information) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). AirPocket, based on its judgment, will continue to enhance its security procedures as new technology becomes readily available. However, since there is no such thing as "perfect Internet security," AirPocket cannot guarantee 100% security. AirPocket does not have access to private e-mail communications and text messages that are transmitted using AirPocket services.
We collect information about your activity on AirPocket Applications for a number of purposes using technologies such as cookies, web beacons, widgets and server log files. We and our authorized AirPocket advertising partners use that information, as well as other information they have or we may have, to help tailor the ads you see on our sites and to help make decisions about ads you see on other sites. We use third-party advertising companies to serve ads on our behalf. These companies employ cookies and action tags to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous.
If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out by email at email@example.com. To opt out of cookies email us at firstname.lastname@example.org. Please note that by “opting out” you will no longer receive targeted advertising. You will, however, continue to receive general advertising in the form of generic ads.
Our Applications offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. You should not provide personally identifiable information in any publicly accessible blog or community forum.
If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address and automatically generate a one-time email to send your friend inviting him or her to visit the site. AirPocket will retain the information of any individual’s information provided as detailed herein and to track the success of the Refer a Friend Campaign.
Occasionally, we may conduct surveys on our Applications. Surveys are conducted at random and are completely voluntary to our Application visitors. The survey may require a customer to provide customer identifiable information in exchange for the information or services provided by the survey. We may use this information in an aggregate manner to better tailor the types of services, information, and advertising that are provided on our Applications.
AirPocket Applications are not structured to attract children under the age of 13. AirPocket believes there is no information on its Applications which are inappropriate or objectionable for viewing by children. AirPocket does not knowingly, directly or passively collect information from children under the age of 13. Ordering online products and services from AirPocket is limited to adults (ages 18+).
Of course, wireless services purchased for family use may be used by minors without the knowledge of AirPocket. If that happens, any information collected from the usage will appear to be the personal information of the actual adult subscriber and treated as such under this Policy.
